ITC investigates Samsung hardware following Ericsson complaint

THE UNITED STATES International Trade Commission (ITC) will start looking at Samsung hardware and assessing whether a complaint made by Ericsson against it is fair.

The ITC said it has voted to begin an investigation, adding that it will look at certain wireless communications and electronic devices. This will extend to smartphones, base stations, media players, tablet computers and televisions.

The investigation follows a complaint from rival Ericsson that said the hardware and its components infringe its patents.

Ericsson, it added, is looking to get “an exclusion order and cease and desist orders” out of it, but the ITC has only just begun and isn’t talking about what it expects to find.

According to Samsung the firm has already tried to address Ericsson’s concerns and negotiate with it, however apparently those efforts weren’t successful. A spokesperson said that the firm will do all that is necessary to protect its interests.

“We have sought to negotiate with Ericsson in good faith. However, Ericsson has proven unwilling to continue such negotiations by making unreasonable claims, which it is now trying to enforce in court,” it said in an emailed statement.

“Under such circumstances, we have no choice but to take the steps necessary to protect our company.”
